Welcome to Patyrn! These Terms of Service (“Terms”) govern your access to and use of the Patyrn application, website, and services (collectively, the “Services”). Please read these Terms carefully. By creating an account or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Services, you confirm that you can form a binding contract with Patyrn, that you accept these Terms, and that you agree to comply with them. If you do not agree to these Terms, you must not use our Services.

2. User Accounts

To access most features of our Services, you must register for an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Promptly notify us if you discover or otherwise suspect any security breaches related to the Services.
  • Be responsible for all activities that occur under your account.

3. User-Generated Content

a) Your Content is Yours

You retain all ownership rights to the content you create, upload, or post on the Services, including your patterns, designs, and any images you upload (“User Content”).

b) License You Grant to Us

To operate and provide the Services, you grant Patyrn a limited, worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and display your User Content. This license is solely for the purpose of operating, developing, providing, and improving the Services, such as displaying your designs in your account and generating previews.

4. Acceptable Use

You agree not to use the Services to create, upload, or share any content that:

  • Is unlawful, libelous, defamatory, obscene, pornographic, indecent, or harassing.
  • Violates the copyright, trademark, or other intellectual property rights of any other person.
  • Contains viruses, corrupted data, or other harmful, disruptive, or destructive files.
  • Is used for any illegal or unauthorized purpose or engages in, encourages, or promotes any illegal activity.

5. Paid Services and Subscriptions

We offer optional paid services, such as the “Patyrn Pro Toolkit” and the “Creators Asset Pack” (“Paid Services”).

  • Payments: By purchasing Paid Services, you agree to pay the specified fees. All payments are processed by a third-party payment processor.
  • Billing: We may offer one-time purchases or recurring subscriptions. Subscriptions will automatically renew unless you cancel them.
  • No Refunds: Payments are non-refundable, except where required by law.

6. Intellectual Property

Excluding your User Content, all aspects of the Services, including our provided clipart, fonts, mockups, software, logos, and branding, are the exclusive property of Patyrn and its licensors. You are granted a limited, non-sublicensable license to access and use these assets within the Services as permitted by your subscription tier. You may not extract, resell, or use these assets outside of the Patyrn application.

7. Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice or liability, for any reason, including if you breach these Terms. You may delete your account at any time by contacting us.

8. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, PATYRN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

9. Changes to the Terms

We may modify these Terms from time to time. If we make material changes, we will provide you with notice, such as by sending an email or displaying a notice within the Services. Your continued use of the Services after any modification constitutes your acceptance of the new Terms.
